This privacy policy describes the information that Van Oorschot Law Group, PC (“VOLG”) collects through its website (the “Website”), and how VOLG uses that information. This Privacy Policy does not apply to VOLG’s collection of information by any other means, including without limitation from its clients in the course of representing them.

We created this Website Privacy Policy (“Privacy Policy”) to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair information practices and the protection of privacy. This Privacy Policy is only applicable to the Site, and not to any other websites that you may be able to access from the Site, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy. This Site is intended for the personal use of individuals who reside in the United States interested in learning about the Company or purchasing Company products. This Site is not intended to attract or be used by minors under the age of 18 without verifiable parental consent.

1. INFORMATION COLLECTED AND USE. 

a. Personal Information.  You need not provide VOLG with personally identifying information (e.g., name, telephone number, email address) as a condition of using the Website. However, failure to provide certain personally identifying information into our contact submission form will prevent certain features of the Website from functioning, or may prevent VOLG from effectively responding to Your requests. The Website will collect only that personally identifying information that You affirmatively provide in response to a direct request.

The Website and VOLG will use the personally identifying information You provide to perform the function or functions in connection with which You provide it. VOLG may disclose Your personally identifying information to third parties who assist VOLG in performing those functions, provided those third parties have agreed to abide by this Privacy Policy. VOLG will not disclose Your personally identifying information to unaffiliated third parties for direct marketing. VOLG reserves the right to disclose Your personally identifying information under the following circumstances: (1) when required to do so by law; (2) in response to a subpoena, court order, or other valid process; or (3) when VOLG believes in its sole discretion that disclosure is necessary to protect the property or rights of VOLG, third parties or the public at large.

b. Non-personal Information.  We automatically track and collect the following categories of information when you visit our Site: (1) IP addresses; (2) domain servers; (3) types of computers accessing the Site; and (4) types of web browsers used to access the Site (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Site. We may also send to your computer one or more cookies, which are small text files containing a string of characters that store information about a visitor when he or she navigates from one Web page to another. The Site’s cookies hold users’ unique session identifiers, allowing our server to return correct information back to the user during navigation of the Site. Such information includes the user’s shopping cart items, or whether he or she is logged in when requesting to view or modify personal information, including e-mail address, which may have been stored in our database in the past. These cookies uniquely identify your computer to the Site, but do not facilitate the gathering of personal information. We use cookies to improve the quality of our service by storing user preferences and tracking user trends. Most web browsers are set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent.

Furthermore, our computer servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as the date and time of your access to the Site, the length of time of your visit, the portions of the Site accessed, the number of times you visit and purchase from the Site, the IP address assigned to your computer, the type of browser used by your computer, the domain from which your connection to the Site originates, and one or more cookies that may uniquely identify your computer. We assign you a unique internal identifier to help keep track of your future visits. We use this information to gather aggregate demographic information about our visitors, and we use it to personalize the information you see on the Site and the e-mails you receive from us (should you grant us permission to send e-mails to you). We keep this information for our internal use; we do not share it with others. This information is in no way tied to your personal information, including your e-mail address.

c. Children. The Website is not directed to children under thirteen years of age. It is the policy of VOLG not to knowingly collect personally identifiable information children under the age of thirteen.

2. Security of Personal Information. VOLG has implemented and maintains reasonable security procedures and practices to protect against the unauthorized access, use, modification, destruction, or disclosure of Your personally identifying information.

3. California Do-Not-Track Disclosures. Without changing or revoking any of Your privacy protections contained in this Privacy Policy, VOLG does not alter its behavior or change its services upon receiving “do-not-track” signals, as the term appears in Cal. Bus. & Prof. Code §§ 22575(b)(5). 

4. DISCLAIMER OF WARRANTY. Users expressly agree that use of the service is at their sole risk. Neither the Company, its affiliates nor any of their respective employees, agents, third-party content providers or licensees, if any, warrant that the service will be uninterrupted or error free, nor do they make any warranty as to the results that may be obtained from use of the service or as to the accuracy, reliability or content of any information, service or merchandise provided through the service.  The service is provided on an “as is” basis without warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.

Each user specifically acknowledges that in no event will the Company, its affiliates nor any of their respective employees or agents be liable for any direct, indirect, incidental, special or consequential damages arising out of (i) the use by such user of any browser owned or operated by any party and/or (ii) the downloading of any software owned or operated by any third party in connection with the service. Each user shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of the service, and users shall be responsible for all charges related thereto.

5. THIRD-PARTY LINKS. VOLG has no control over, and no liability for any third party websites or materials. VOLG works with a number of partners and affiliates whose Internet sites may be linked with the Site including, but not limited to: LawPay, Facebook, Dropbox, Google, and Constant Contact. Because neither VOLG nor the Site has control over the content and performance of these partner and affiliate sites, VOLG makes no guarantees about the accuracy, currency, content, or quality of the information provided by such sites. By visiting or using Third-Party Websites, You assume all responsibility and liability for all resulting harms, whether to You or to any third party, including without limitation as resulting from Your downloading or use of any content, software or other materials available therefrom.
